CONDITIONS GÉNÉRALES DU CONCOURS DEUX OCÉANS 2025
Les participants sont encouragés à lire attentivement les conditions générales du concours. Ces conditions générales ne visent pas à restreindre, limiter ou contourner illégalement les droits ou obligations imposés au participant ou à l'organisateur en vertu de la loi n° 68 de 2008 sur la protection du consommateur (« LPC »).
En participant au concours, le participant confirme qu'il a eu suffisamment de temps pour examiner ces termes et conditions et qu'il les comprend pleinement et accepte de les respecter.
RÈGLEMENT DU CONCOURS
Admissibilité:
- Le concours est ouvert à tous les lecteurs du Cape Town Magazine.
- Une seule participation par personne est autorisée.
- Les participants doivent résider en Afrique du Sud.
- Les participants doivent être âgés de 18 ans ou plus.
- En participant au concours, le participant garantit par la présente que toutes les informations soumises sont vraies, à jour et complètes.
Entry Method:
- To participate, entrants must complete the provided quiz in full. The quiz can be accessed via the competition page (link to be shared soon).
- Participants must answer all questions in the quiz correctly or submit their responses by the deadline to qualify for the prize draw. Incomplete or incorrect submissions may be disqualified.
Deadline:
- Entries must be submitted by 11:59 PM SAT on April 3, 2025. Late entries will not be accepted.
Prize:
- The prize is a 14K Yellow Gold Limited Edition Two Oceans Diamond Pendant.
- The prize is non-transferable and cannot be exchanged for cash or other alternatives.
- The prize will be made available for the winner to collect at their convenience and within the agreed-upon time limits by the organiser. Entrants must be available to accept their prize in Cape Town.
SELECTION OF WINNERS
- One winner will be randomly selected from all eligible entries who successfully complete the quiz.
- The draw will take place on 4 April 2025 at 09:00 AM SAT.
- The winner will be notified via email within 2 hours of the draw.
- If the winner does not respond within 2 days, an alternate winner may be selected through a re-draw from the eligible entries.
- A potential prize winner is not an actual winner until their submission or entry is validated. In the event of non-compliance with these terms and conditions, the prize will be forfeited, and a re-draw will take place.
- The organiser reserves the right to disqualify a winner if they do not respond to the notification email within 2 days. A replacement winner will then be randomly selected, and the same response requirements will apply. If the selected winner does not have valid contact details, a redraw will take place.
ELIGIBILITY CLAUSE
Employees, directors, agents, and immediate family members of the organiser, as well as any affiliated entities, are not eligible to enter the competition.
GENERAL
- By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA"), and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize, you undertake to expeditiously do all things necessary to enable the organiser to comply with its obligations under the CPA, including but not limited to:
- Providing such personal information as may be required to facilitate handing over the prize (including proof of address and identity number); and
- Signing receipt of the prize upon its delivery.
- The organiser reserves the right to amend these terms and conditions or terminate the competition for valid reasons, such as unforeseen circumstances or legal requirements. Any amendments will be communicated to participants via the competition’s official platform(s) in advance, where feasible. In the event of such termination, all participants agree to waive any rights they may have in terms of the competition and acknowledge that they will have no recourse against the organiser.
- In the event that the prize becomes unavailable due to circumstances beyond the organiser’s control, the organiser reserves the right to substitute the prize with an alternative of equal value. The organiser will notify the winner of such changes and provide full details about the substituted prize.
- The organiser is not responsible for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication line failures, theft, destruction, alteration, unauthorized access to entries, or entries that are lost, damaged, or delayed due to server issues, technical malfunctions, viruses, bugs, or other factors beyond the organiser’s control.
- The laws of the Republic of South Africa will govern the Competition Rules, and any disputes will be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
- The name of the prize winner will be published on the organiser’s social media platforms.
- By entering, participants agree to the competition rules and the use of their name for promotional purposes if they win. The winner may be requested to take part in the organiser’s publicity campaigns or to allow their name and likeness to be used for promotional purposes.
- The organiser will oversee the competition, and all decisions regarding any aspect of the competition, including the selection of the prize winner, are final. No correspondence or discussions will be entered into.
PROTECTION OF PERSONAL INFORMATION
Personal information collected during the competition will only be used for purposes directly related to the competition. The organiser undertakes not to share, sell, or misuse personal information and to ensure its security. Participants may withdraw their consent to data processing at any time, but such withdrawal may affect their participation in the competition where such data is necessary for prize allocation or communication.
